These cases span from the mundane to the complex, although at times it seems the matters extend from the existential to the mystical. The fact that a case may be mundane, however, does not mean it calls for a mundane attorney. Indeed, a routine complaint does not necessarily call for a routine answer. Creativity, however, has to be tempered with reality. It is one thing to raise violation of the anti trust laws as a defense to a mortgage foreclosure, which had a basis in the evidence as Schwartz has done in the past; it is quite another thing to raise Magna Carta and the Thirteenth Amendment as a defense to a mortgage foreclosure, which was clearly absurd, as Schwartz' opponent did in another case. Business and Commercial Litigation
Most commercial disputes focus on the underlying documents, whether the lawsuit is over a purchase and sale of goods or of a business, a breach of contract or of fiduciary duty, a business break up or a dissolution, tortious interference or fraud. Experience in these types of disputes is imperative in not only analyzing the documents but also integrating them into the theory of the case and presenting them in an effective manner as part of the complaint, dispositive motion, at a deposition or at time of trial.
Another key to handling business litigation is the strategy concerning the causes of action and defenses. There is little skill in identifying the obvious claims and defenses; nor does it take a lot of talent involved in uncovering the less obvious. Experience plays a major factor in whether to assert obvious or creative claims and defenses (does pleading a marginal claim undermine the strong claim or does raising a weak defense open areas of discovery that are better left alone?), or when to assert those claims (at the onset, or after some discovery has been taken?). The Firm certainly does not possess unique prophetic talents with respect to these tactics. Nonetheless, Schwartz has in excess of 25 years experience in these types of cases and has first hand knowledge on what carries the day and what sinks the ship.
