Most of these cases involving the balance owed on the contract, including extras, less set offs to correct any defects or breach of warranties. Although these cases are generally are not complex, there are quite a few factors that increase their complexity. For example, if the homeowner sues for Consumer Fraud, the homeowner may be able to recover attorneys' fees. Certain allegations in the complaint if properly couched in negligence may trigger insurance coverage. An investigation into the solvency of the property owner or general contractor may make a breach of contract action more economical than a mechanic's lien foreclosure, although the lien might remain in place during the pendency of the lawsuit.
The overwhelming majority of construction type lawsuits are settled either prior to trial or by the trier of fact, whether judge, jury or arbitrator. Very few parties obtain a 100% victory and for those who do, the cost in terms of attorneys fees often exceed what they may have settled for prior to trial. As one client stated to a judge during a settlement conference "I was told that if I want fairness, I should go to a brothel. If I want to be taken advantage of, I should go to court." (Euphemisms added.) Hence, construction disputes are especially suited for alternative dispute resolution. Nonetheless, these types of cases must be handled and the attorney and the client must be prepared to take the case to trial.
