Marty J. Schwartz has devoted his entire legal career (in excess of 25 years) to business/commercial litigation. Of course, experience means nothing in and of itself. As one City official said during a deposition involving the failure to promote employees who had been employed for many years, "experience only means that the person makes the same mistakes over and over again." Nonetheless, experience has its advantages in understanding the expectations of certain judges, the tendencies of opposing counsel, what tactics have been successful or unsuccessful in the past and more importantly why. Even a new attorney can file a pleading or motion, take discovery and perhaps handle a trial. Through extensive years of practicing in the same area, Schwartz can focus on what motions and discovery advance the overall strategy of the case and what type of trial tactics are most likely to be triumphant.

Years of experience have also demonstrated that extending professional courtesies to the opposing counsel and generally being cooperative makes the case more efficient to handle and allows the court to focus on the merits of the case. Such cooperation never interferes with the ultimate strategy of obliterating your opponent if a reasonable resolution cannot be reached.

Some cases require a more creative approach than others. Creativity, however, does not mean making up causes of action that do not exist, or raising Magna Carta or Thirteenth Amendment to defend a foreclosure (as one of my opponents did), which merely convince the judge that you have no idea of what you are doing. (As Mark Twain said, "It is better to keep your mouth closed and let people think you are a fool than to open it and remove all doubt.") Rather difficult cases may necessitate ingenuity to demonstrate that the existing facts fit recognized causes of action, or require resourcefulness to obtain the evidence necessary to sustain a cause of action.

The most effective litigation tool is to be prepared and know your case. To that end, Schwartz more than tripled the size of the firm since 2005, employing two full time associates, in addition to utilizing of counsel relationship with several additional attorneys, and adding additional support staff. Each case has one support staff assigned to it as well as one or more attorneys. All support staff members are knowledgeable, helpful, friendly (at least on a good day, following a full moon in a leap year) and (hopefully) have a sense of humor.
